Tenancy Contract Details:
Name of the Law shall be called as “Law Regulating Relationship between Landlords and Tenants in the Emirate of Dubai No. 26 of 2007”. There are several words which have been defined with the context to have clarity in the Law. This law contains tenancy contract details which introduces the tenancy relationship between tenant and landlord.
Period of Tenancy:
The law specifically defines the period of tenancy with a condition that if tenant is occupying after expiring of the contract without any objection from the landlord, the contract must be renewed for net one year with same terms and conditions.
Rent Value:
Another important portion of the Law is Rent Value component along with its payment schedule and inclusions. Both parties must specify the rent value on the contract clearly. So be careful while going through the contract during house and apartment for rent.
Obligations and Responsibility of Landlord:
There are certain important obligations which landlords need to be responsible for, like landlord must be committed to handover the property in good condition and must be liable of taking care of all maintenance of the property during the whole tenure.
Tenant’s Responsibility:
Similarly, even tenant are also having certain obligations towards property and the landlord. This include timely payment of rent, payment of maintenance deposits if required by the landlord at the time of expiry of the contract, returning the property in good condition upon expiry of the contract, and liability to pay any fees pertaining to government while staying in the premises as tenant.
Sublease the property:
The most important part of the contract is eviction. The landlord may demand eviction at certain point even when the contract is not expired. Situations like tenant fails to pay rent on time, if tenant sublease the property without permission of the landlord, if tenant is using the property for some illegal activities, if tenant may cause endanger to the property, and other such situations.
Apart from these, certain general rules also have been implanted in the law which will help both landlords and tenants to hold their interest.
